Non Profit Formation in South Carolina
To form a non profit organization in South Carolina, you must file non profit articles of incorporation on a form prescribed by the South Carolina Secretary of State. The articles must be filed in duplicate, along with a $25.00 filing fee, to the Secretary of State, Attn: Corporate Filings, 1205 Pendleton Street, Suite 525, Columbia, SC 29201. A “501c3 Attachment” must also be filed along with the articles if the corporation is applying for 501c3 tax exemption status with the IRS.
Federal Tax Exemptions
In order to be tax exempt as a 501c3, after incorporation, your South Carolina non profit must complete and submit Form 1023 to the Internal Revenue Service for processing and approval. The process for approval typically takes about 3 – 5 months. Once approved, your organization will receive a Determination Letter from the IRS granting tax exempt status as a 501c3.
State Tax Exemptions
