State Tax Exemptions

Charitable non profit organizations are exempt from Michigan income taxes upon receiving their Letter of Determination establishing the organization’s tax exempt status from the Internal Revenue Service.  Once federal exemption has been attained, you may submit a copy of the IRS’ Determination Letter to the Michigan Department of Revenue.  The Department’s phone number is (602) 255-2060.  Generally, sales made to churches, schools and other non profit organizations are subject to Transaction Privilege and Use Tax.  However, retail sales (not purchases) made by a non-profit charitable 501c3 organization that is duly recognized by the IRS are exempt from the Transaction Privilege Tax.  You should contact the Michigan Department of Revenue for specific instructions as to how to apply for an exemption from the Transaction Privilege Tax as an IRS-recognized charitable organization.    

Charitable Solicitation

Before soliciting contributions in Michigan, a charitable organization must file a registration statement with the Office of the Secretary of State of Michigan.  The Charitable Organization Registration Form may be obtained from the Secretary of State/Charities Division.  The phone number for the Charities Division office is 602-542-6187.  There is no charge to register the charitable organization with the Secretary of State.  A charitable organization must renew its registration with the Secretary of State on an annual basis every September 30.
